Last Updated: 6-14-2025 These Terms of Service (“Terms”) apply to your use of the website, digital content, and services provided by Pediatric Course Academy (“we”, “us”, or “our”), including our pediatric and newborn educational platform (“Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility and Use

• You must be at least 18 years of age to use our Service.

• You may not use the Service for unlawful, harmful, or abusive purposes.

• You may not submit Protected Health Information (PHI) unless you have the legal

right to do so (e.g., you are the parent or guardian of the child described).

2. HIPAA Compliance Notice

We comply with HIPAA when we collect, store, or transmit PHI. If you are a covered entity under HIPAA (e.g., pediatrician, nurse, healthcare facility), we may enter into a Business Associate Agreement (BAA) upon request. However:

• Our Service is not intended to function as a substitute for a healthcare provider or Electronic Health Record (EHR) platform.

• No diagnosis, medical treatment, or therapeutic recommendations are provided

through this platform.

3. No Medical Advice Disclaimer

The information on this platform is for educational purposes only and is not a substitute for professional medical advice. Always consult a qualified pediatrician or healthcare provider. Use of this Service does not establish a doctor-patient relationship.

4. Intellectual Property

All content—including videos, PDFs, graphics, and branding—is owned by or licensed to Pediatric Course Academy. Unauthorized reproduction or redistribution is prohibited.

5. User Content

If you submit a question or comment:

• You grant us a non-exclusive, royalty-free license to use it (anonymized) for training or

marketing.

• Do not submit medical records or sensitive images unless explicitly requested and

protected via secure upload.

6. Payments, Access, and Refunds

• Course access is granted after successful payment.

• Refunds are Not offered due to intellectual property

• Subscription fees (if any) are billed in accordance with your selected plan.

7. Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms

• Submit fraudulent payment information

• Misuse or exploit platform features

8. Dispute Resolution

All disputes will be governed by the laws of TN, and resolved through binding arbitration, unless otherwise required by law.

9. Limitation of Liability

To the extent permitted by law, Pediatric Course Academy shall not be liable for:

• Medical decisions made based on course content

• Data breaches caused by user negligence

• Loss of profits, goodwill, or any indirect damages

10. Binding Arbitration, Class Action Waiver & Indemnification

a. Binding Arbitration Agreement

By using our Service, you agree that any dispute, claim, or controversy arising out of or relating to your access to or use of Pediatric Course Academy’s services or products—including but not limited to any course content, medical disclaimers, data handling, or privacy issues—shall be resolved through final and binding arbitration, and not in a court of law.

Location: Arbitration shall be conducted in TN, unless otherwise agreed in writing.

Governing Rules: Arbitration shall be conducted under the Commercial Arbitration

Rules of the American Arbitration Association (AAA) or another mutually

agreed provider.

Arbitrator’s Authority: The arbitrator shall have exclusive authority to resolve all

disputes, including disputes over the enforceability of this clause.

Individual Claims Only: You agree to waive any right to participate in a class action,

class arbitration, or other representative proceeding. All claims must be brought

individually.

You acknowledge that by agreeing to arbitration, you are waiving the right to a jury trial or to bring claims in a traditional court of law.

b. Release and Waiver of Claims

To the fullest extent permitted by law, you hereby release, waive, and discharge Pediatric Course Academy, its officers, directors, agents, affiliates, instructors, contractors, and employees from any and all liability, claims, damages, losses, or expenses—whether direct or indirect, foreseeable or unforeseeable—arising from or

related to:

• Your use or misuse of the Service

• Your reliance on any information provided

• Any interactions with third parties facilitated by the Service

• Any alleged violation of rights, including HIPAA or consumer protections

This includes claims for negligence, breach of contract, misrepresentation, or product

liability.

c. Indemnification

You agree to defend, indemnify, and hold harmless Pediatric Course Academy, and its affiliates, directors, officers, agents, employees, contractors, licensors, and suppliers, from and against any and all third-party claims, liabilities, damages, losses, and expenses—including reasonable attorney's fees and costs—arising from or related to:

• Your use of the Service

• Any data or content you submit

• Your violation of these Terms

• Your violation of any rights of another person or entity

• Any dispute between you and a healthcare provider or third party

d. Survival of Terms

This Arbitration & Indemnification section shall survive the termination of your relationship with Pediatric Course Academy and the cessation of use of the Service.
